These Terms form a binding agreement between you and USA Sport AZ Inc., doing business as InsiderMTB.com and iMTB Race Chase (“iMTB,” “we,” “us,” or “our”). By accessing the service, creating an account, claiming a profile, or submitting content, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
Eligibility and accounts
You must be at least 13 to create an account. If you are under the age of legal majority where you live, a parent or legal guardian must authorize your use and is responsible for it. Children under 13 may not create accounts or submit personal information. You must provide accurate information, protect your credentials, use only accounts you are authorized to use, and promptly report suspected unauthorized access.
The Race Chase service
Race Chase organizes race information, editorial coverage, rankings, and independently calculated points. Unless expressly stated, iMTB is not a race organizer, timing official, sanctioning body, team, athlete agent, medical provider, or representative of USA Cycling, the UCI, an event, or a sponsor. Trademarks belong to their owners. References to events, governing bodies, teams, products, or sponsors do not imply endorsement.
Results, dates, classes, timing, eligibility, points, rankings, links, and coverage may contain source errors, delays, omissions, or later corrections. Official organizer or governing-body records control where applicable. Do not rely on the service for emergency, navigation, medical, registration, eligibility, or safety decisions.
Your submissions and license
You retain ownership of content you lawfully submit. You grant iMTB a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reproduce, format, adapt, display, publish, distribute, and otherwise use that content as reasonably necessary to operate, secure, promote, and improve the service. A separately signed rider media release governs name, likeness, photograph, media, and publicity uses covered by that release and controls if it conflicts with this general content license.
You represent that you own or control the necessary rights; your submission is accurate and lawful; and it does not violate privacy, publicity, copyright, trademark, contract, confidentiality, or other rights. You are responsible for obtaining permission from anyone identifiable in submitted material.
Profile and team claims
A claim requests administrative access; it does not create ownership of a factual result, ranking, team name, event record, or page. We may require verification, contact a team or event, approve, reject, suspend, transfer, or revoke access, and preserve an audit trail. Impersonation, false authority, fabricated credentials, or unauthorized access is prohibited.
Acceptable use
- Do not break laws, infringe rights, harass, threaten, exploit, or endanger another person.
- Do not submit sexual content involving minors, private identifying information, malware, spam, deceptive promotions, or fraudulent claims.
- Do not scrape, harvest, reverse engineer, overload, bypass security, evade access controls, automate abusive requests, or use service data to build a competing database without written permission.
- Do not alter or misrepresent results, impersonate riders or teams, interfere with reviews, or falsely suggest endorsement.
We may investigate, preserve evidence, restrict visibility, remove content, suspend access, or notify appropriate parties when reasonably necessary to enforce these Terms or protect the service.
Third-party services, promotions, and purchases
The service may link to livestreams, shops, event registration, social networks, sponsors, codes, or other third parties. Their terms, privacy practices, availability, products, and claims are their responsibility. A discount or promotional code may expire, have separate conditions, or be withdrawn. Unless expressly stated, iMTB is not the seller and does not guarantee a third-party product or transaction.
Intellectual property and notices
The service design, software, compilation, original graphics, editorial work, Race Chase scoring presentation, and iMTB marks are owned by or licensed to us and protected by law. Limited personal, noncommercial use is permitted. To report alleged infringement, identify the protected work, the challenged material and location, your contact details, a good-faith statement, an accuracy-and-authority statement under penalty of perjury, and your physical or electronic signature; send the notice to aw@usasportinc.com.
Your responsibility
To the extent permitted by law, you will defend, indemnify, and hold harmless iMTB and its affiliates, officers, employees, contractors, and licensors from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use of the service, your submission, your violation of these Terms, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from iMTB’s own unlawful conduct and does not limit non-waivable consumer rights.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. NOTHING IN THE SERVICE IS PROFESSIONAL, MEDICAL, SAFETY, OR LEGAL ADVICE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THEY APPLY ONLY TO THE EXTENT LAWFUL.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, iMTB AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE PROHIBITED OR TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
Suspension, termination, and deletion
You may stop using the service or delete your account. We may suspend or terminate access for violations, risk, legal requests, or discontinuation. Account deletion is governed by the Privacy Policy. Factual race records, de-identified information, and records we are legally entitled or required to retain—including signed releases and transaction evidence—may survive deletion. Provisions that by their nature should survive will survive.
Disputes and general terms
These Terms are governed by Arizona law, without regard to conflict-of-law principles. Any dispute must be brought in a state or federal court with jurisdiction in Arizona, except where applicable consumer law requires otherwise. Before filing, each party agrees to send written notice and attempt in good faith for 30 days to resolve the dispute informally.
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce is not a waiver. You may not assign these Terms without consent; we may assign them with the service or business. These Terms, the Privacy Policy, and any separately signed release are the entire applicable agreement and supersede prior statements on the same subject.
Changes and contact
