Rider Name, Likeness, Photograph, Media and Publicity Release

In consideration of my participation in and access to the iMTB Race Chase profile, results, editorial, promotional and media services, and for other good and valuable consideration, receipt and sufficiency of which are acknowledged, I irrevocably grant USA Sport AZ Inc., doing business as InsiderMTB.com and iMTB Race Chase, and its parents, affiliates, successors, assigns, licensees, sponsors, event partners, contractors and authorized media partners (collectively, “Released Parties”) the perpetual, worldwide, royalty-free, fully paid, transferable and sublicensable right and permission to photograph, record, reproduce, edit, adapt, crop, modify, publish, display, distribute, transmit, broadcast, livestream, archive and otherwise use my name, approved profile information, photograph, image, likeness, appearance, voice, statements, biography, team affiliation and materials I submit (“Materials”), alone or with other material, in any media or technology now known or later developed.

This permission applies to InsiderMTB.com, iMTB Race Chase, websites, mobile and connected-device applications, live streams, broadcasts, podcasts, race and event coverage, social media, email, advertising, publicity, promotion, editorial features, sponsor presentations, historical archives and internal business materials. The Released Parties may identify me by name, team, class, hometown and other approved profile information. The Released Parties are not required to use the Materials and do not owe me approval rights, notice, compensation, royalties or an accounting for an authorized use.

I waive any right to inspect or approve the finished use and, to the fullest extent permitted by law, release and agree not to assert claims against the Released Parties arising from an authorized use of the Materials, including claims for invasion of privacy, right of publicity, misappropriation, defamation based on authorized editing or context, or copyright infringement. This release does not authorize a knowingly false endorsement, unlawful use, or materially deceptive alteration, and it does not waive rights that cannot legally be waived.

I represent and warrant that I am the person identified in the claimed racer profile; the information I provide is accurate; I own the submitted Materials or have all permissions needed to grant these rights; the Materials do not violate another person’s rights; and I have legal capacity to sign. If the rider is under 18, the signer represents that they are the rider’s parent or legal guardian, has authority to sign for the rider, grants the permissions above on the rider’s behalf, and consents to the rider’s participation and profile.

I understand that submitted photographs may be processed using automated image tools to crop, resize, remove or replace backgrounds, improve presentation, create a transparent cutout and generate platform-ready formats. An authorized reviewer must approve a processed image before it is published. This permission does not authorize a materially deceptive alteration or a false statement that I endorse a product, service or position.

Official timing, race results, rankings, points and historical records are factual competition records controlled by the applicable organizer and iMTB Race Chase rules and are not editable through a claimed profile. Profile access may be suspended or revoked for fraud, impersonation, policy violations or safety concerns, without ending rights already granted for Materials previously used in reliance on this release.

This is a media and publicity release only. It is not an event-participation waiver, assumption-of-risk agreement, medical authorization or release of liability for racing, training, travel, course conditions, equipment or bodily injury. Any event organizer’s separate registration terms or waiver are independent of this release.

I may ask iMTB in writing to stop new, optional uses of unpublished Materials. Any request is prospective only and does not require recall of materials already printed, published, distributed, licensed, committed to production or incorporated into an archival, editorial or historical record. Rights and records reasonably needed to document prior authorization, protect legal rights, resolve disputes or comply with law survive account deletion and any later request.

This release is governed by Arizona law, without regard to conflict-of-law principles. Any dispute shall be brought in a state or federal court with jurisdiction in Arizona, except where applicable law requires otherwise. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue in effect. This release is the entire agreement concerning the rights granted here and may be changed only in a writing signed by the affected parties.

By checking the consent box and typing my full legal name, I confirm that I had an opportunity to read this complete release, understand it, am signing voluntarily and intend to be legally bound. I intend my typed name to be my electronic signature and understand that it has the same intended force and effect as a handwritten signature. I consent to transact electronically, can access and retain this agreement, and understand that iMTB will preserve the exact release version, acceptance time, signer information and integrity evidence as a restricted legal record.
